The Painted Horse Foundation, Inc. (the “Foundation,” “we,” “us,” or “our”) respects your privacy. This Privacy Policy describes how we collect, use, disclose, and protect personal information when you visit thepaintedhorsefoundation.org (the “Site”), make a donation, register for an event, subscribe to our communications, or otherwise interact with us through the Site. It also describes the choices available to you regarding your information.
We are committed to treating the information you share with us, especially information about your family and your loss, with compassion, discretion, and care.
By using the Site, you acknowledge that you have read and understood this Privacy Policy. This Policy is incorporated into our Terms and Conditions. If you do not agree with our practices, please do not use the Site.
2. Information We Collect
2.1 Information You Provide to Us
We collect information you choose to provide, which may include:
• Contact and inquiry information. When you use our contact form or otherwise communicate with us (for example, to request support, ask a question, volunteer, or explore a partnership), we collect the information you provide, such as your name, email address, phone number, organization, and the content of your message.
• Donation information. When you donate, we collect your name, email address, billing information, donation amount and frequency, and any optional information you provide (such as a dedication or whether you chose to cover processing fees). Payment card details are collected and processed by our payment processor, not by us, as described in Section 4.
• Event and purchase information. When you register for an event, purchase tickets, or become a sponsor, we collect the information needed to process and administer your registration or purchase, such as name, contact details, billing information, participant information, and, where relevant, information such as t-shirt size or team name.
• Newsletter subscriptions. Our email newsletter sign-up is hosted by Flodesk, our email service provider. Information you submit on the Flodesk-hosted subscription page (such as your name and email address) is collected by Flodesk on our behalf and is also subject to Flodesk’s privacy policy.
• Sensitive information you choose to share. Families seeking support may choose to share information about their circumstances, including information about a pregnancy or child loss, health matters, or financial hardship. We collect this information only when you voluntarily provide it, we use it only to understand your needs and provide support and resources, and we limit access to those who need it to serve you. Please share only what you are comfortable sharing.
2.2 Information Collected Automatically
When you visit the Site, certain information is collected automatically through cookies and similar technologies, including:
• Device and browser information, such as browser type, operating system, and screen characteristics;
• Usage information, such as the pages you view, the links you click, the site that referred you, and the dates and times of your visits; and
• Network information, such as IP address and approximate (city-level) location derived from it.
The Site is built on the Squarespace platform, and Squarespace collects this information on our behalf to operate the Site and to provide us with site analytics (such as visitor counts and traffic sources). 2.3 Information from Third Parties
We may receive information about you from service providers involved in your transactions (for example, confirmation from our payment processor that a donation succeeded or failed, or chargeback and fraud-prevention information) and from social media platforms if you interact with our pages or posts on those platforms.
3. How We Use Information
We use personal information to:
• Process donations, event registrations, ticket and sponsorship purchases, and send related receipts, acknowledgments, and confirmations (including tax acknowledgment letters);
• Administer recurring donations, including scheduled charges and cancellation requests;
• Respond to your inquiries and requests, including requests for support, volunteer inquiries, and partnership inquiries;
• Evaluate and administer our support and financial assistance programs;
• Plan and operate events, including participant communications, safety, and logistics;
• Send you our newsletter and other updates about the Foundation, if you have subscribed or otherwise agreed to receive them (you may opt out at any time);
• Operate, maintain, secure, and improve the Site, including analyzing how visitors use it;
• Prevent, detect, and address fraud, security incidents, and misuse of the Site;
• Comply with legal, tax, accounting, and regulatory obligations, including recordkeeping requirements applicable to charitable organizations; and
• Enforce our Terms and Conditions and protect our rights, our donors, and the families we serve.
We do not use your information to make automated decisions that produce legal or similarly significant effects about you.
4. Payment Information
Payments made through the Site are processed through Squarespace Payments, Squarespace’s payment processing service, which is supported by Stripe, Inc. and its affiliates. When you make a donation or purchase, your complete payment information (such as your card number) is transmitted over an encrypted connection to the payment processor. The Foundation does not receive or store full payment card numbers. The payment processor’s handling of your payment information is governed by its own privacy policy, and it may use fraud-prevention services in connection with your transaction. We receive and retain transaction records (such as your name, the amount, the date, the last four digits of the card, and transaction status) as needed for receipts, reconciliation, tax acknowledgment, and legal compliance.
5. How We Share Information
We do not sell personal information, and we do not rent, trade, or share our donor list with other organizations for their marketing purposes. We share personal information only in the following circumstances:
• Service providers. We share information with vendors that provide services on our behalf, including Squarespace (website hosting, forms, commerce, and site analytics), Squarespace Payments and Stripe (payment processing and fraud prevention), Flodesk (email newsletter services), and providers of email, document storage, accounting, and similar operational services. These providers are permitted to use the information only to provide services to us.
• Event administration. Where necessary to operate an event, we may share limited participant information with venues, timing companies, or similar event vendors.
• Professional advisors. We may share information with our lawyers, accountants, auditors, and insurers where reasonably necessary.
• Legal compliance and protection. We may disclose information if we believe in good faith that disclosure is required by law or legal process (such as a subpoena), or is reasonably necessary to protect the rights, property, or safety of the Foundation, our donors, the families we serve, or others, or to detect and prevent fraud or security issues.
• Organizational changes. If the Foundation is reorganized, merged with another nonprofit, or transfers its programs, personal information may be transferred to the successor organization, subject to substantially similar privacy commitments.
• With your consent. We share information for other purposes (for example, publicly recognizing a donor or sponsor, or sharing a family’s story) only with consent.
We may also use and share aggregated or de-identified information that cannot reasonably be used to identify you (for example, total funds raised or total event participation) for any lawful purpose.
6. Cookies and Analytics
The Site uses cookies and similar technologies provided through the Squarespace platform, including cookies necessary for the Site to function (such as security and shopping cart cookies) and analytics cookies that help us understand how the Site is used. Embedded third-party content on the Site, such as our Instagram feed, may also set cookies. 7. Email Communications and Your Choices
• Marketing emails. You may unsubscribe from our newsletter and other marketing emails at any time by using the unsubscribe link included in each message or by contacting us at contact@thepaintedhorsefoundation.org . We will honor opt-out requests in accordance with applicable law.
• Transactional messages. Even if you opt out of marketing, we may still send you non-promotional messages, such as donation receipts, event confirmations, and responses to your inquiries.
• Recurring donations. You may cancel a recurring donation at any time as described in our Terms and Conditions.
• Cookies. You can manage cookie preferences as described in our Cookie Policy.
8. Data Retention
We retain personal information for as long as reasonably necessary to fulfill the purposes described in this Policy, and thereafter as needed to comply with legal, tax, and accounting obligations, resolve disputes, and enforce our agreements. For example, donation and transaction records are retained in accordance with tax and charitable recordkeeping requirements. When information is no longer needed, we take reasonable steps to delete it or de-identify it.
9. Security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information, including hosting the Site on a platform that provides encryption in transit (HTTPS) and using payment processors that handle card data in accordance with industry security standards (PCI DSS). However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security. Please use care when deciding what information to share, and contact us promptly at contact@thepaintedhorsefoundation.org if you believe your interaction with the Site is no longer secure.
10. Children’s Privacy
The Site is intended for a general audience and is not directed to children under 13, and we do not knowingly collect personal information online from children under 13. Limited information about minors (such as a child’s name for a 5K registration or a family’s reference to a child in a support inquiry) may be provided to us by a parent or guardian, and we use it only for the purpose for which it was provided. If you believe a child under 13 has provided personal information to us directly, please contact us at contact@thepaintedhorsefoundation.org and we will delete it.
11. Your Privacy Rights
Depending on where you live, you may have rights under applicable law regarding your personal information, such as the right to request access to, correction of, or deletion of your personal information, or to receive information about how it is processed. We may need to verify your identity before acting on a request, and we may retain certain information where required or permitted by law (for example, donation records required for tax purposes). We will not discriminate against you for exercising any privacy right.
The Site is operated from the United States and is intended for U.S. audiences. If you access the Site from outside the United States, you understand that your information will be transferred to and processed in the United States, where privacy laws may differ from those in your jurisdiction.
12. Do Not Track and Similar Signals
Some browsers offer “Do Not Track” or similar signals. Like many websites, the Site does not currently respond to Do Not Track signals. You can manage cookies as described in our Cookie Policy.
13. Third-Party Websites and Services
The Site contains links to and embedded content from third-party websites and services, including Instagram, Facebook, Flodesk, and the website of Painted Horse Winery & Vineyards (a separate entity). This Privacy Policy does not apply to those third parties, and we are not responsible for their privacy practices. We may update this Privacy Policy from time to time. When we do, we will post the updated version on the Site and revise the “Last Updated” date above.
